For the recruitment and personnel search of CuraPersonal, department of CuraPersonal GmbH & Co. KG, Frankfurter Str. 63 65760 Eschborn, Germany.
1. Scope of Application
These General Terms and Conditions apply exclusively to all recruitment, placement, integration support, and personnel search services provided by CuraPersonal.
They apply in addition to all recruitment agreements, placement contracts, cooperation agreements, and language or integration support agreements concluded between CuraPersonal and its clients.

CuraPersonal is committed to fair, transparent, ethical, and sustainable recruitment practices in accordance with:
- the principles of the RAL Quality Mark “Fair Recruitment Care Germany” (RAL Gütezeichen Faire Anwerbung Pflege Deutschland),
- the WHO Global Code of Practice on the International Recruitment of Health Personnel,
- the ILO Core Labour Standards,
- and the UN Guiding Principles on Business and Human Rights.
CuraPersonal rejects all forms of exploitation, discrimination, forced labor, coercion, and unethical recruitment practices.
3. Employer Pays Principle
Healthcare professionals and candidates shall not be charged recruitment or placement fees related to their employment placement in Germany.
All placement-related costs agreed within the recruitment process shall generally be borne by the employer or contractual business partner, unless otherwise permitted by applicable law.
CuraPersonal undertakes not to impose unlawful or unfair financial burdens on candidates.
4. Transparency and Written Documentation
All essential recruitment and placement processes shall be documented in writing and communicated transparently to all parties involved.
Candidates and clients receive clear information regarding:
- recruitment procedures
- language training
- visa and relocation support
- employment conditions
- professional recognition procedures
- contractual obligations
- and integration services.
All contractual agreements shall be provided in understandable written form.
5. Personnel Search and Candidate Selection
CuraPersonal undertakes the pre-selection of suitable candidates through:
- application screening
- interviews
- qualification reviews
- and, where possible, reference checks.
Interview coordination and communication with candidates are managed by CuraPersonal.
CuraPersonal does not guarantee the authenticity or completeness of candidate-provided documents issued by third parties unless officially verified by competent authorities.
Recruitment services are carried out in compliance with applicable German laws and ethical recruitment standards.
6.Recruitment and Placement Services
CuraPersonal introduces suitable candidates to clients for potential employment opportunities.
Clients must immediately inform CuraPersonal if a proposed candidate is already known to them or has been previously introduced through another source.

7. Sustainability and Integration Support
CuraPersonal supports the sustainable professional and social integration of international healthcare professionals in Germany.
Support services may include:
- language preparation
- intercultural orientation
- relocation assistance,
- administrative support
- onboarding coordination
- and guidance during professional recognition procedures
The objective is long-term integration and equal participation within the German healthcare system and society.
8.Human Rights and Equal Treatment
CuraPersonal is committed to respecting internationally recognized human rights standards.
No candidate or employee shall face discrimination based on:
- nationality
- ethnic origin
- gender
- religion
- disability
- age
- sexual orientation
- or any other protected characteristic
CuraPersonal promotes equal opportunity, dignity, and respectful treatment throughout the recruitment and employment process.
9. Anonymous Complaints and Reporting Mechanism
CuraPersonal provides candidates, employees, and business partners with the possibility to report concerns or complaints confidentially and anonymously where legally permissible.
Complaints relating to:
- unethical recruitment
- discrimination
- misconduct
- human rights concerns
- or violations of fair recruitment principles
shall be reviewed carefully and treated confidentially.
Reports may be submitted through the official complaint channels provided by CuraPersonal on its website or designated communication platforms.
10. Client’s Duty to Cooperate
Clients shall appoint a responsible contact person for all communication related to recruitment and placement activities.
After successful interviews and candidate selection, the client remains responsible for:
- employment contract issuance
- onboarding procedures
- workplace compliance
- human rights concerns
- and employment-related obligations.
Clients shall provide accurate and timely information necessary for recruitment execution.
11. Changes to Recruitment Requirements
Changes to recruitment requirements must be communicated in writing.

If recruitment services become unnecessary, the client must inform CuraPersonal immediately.
12.Service Provision and Third Parties
CuraPersonal may use employees, freelancers, cooperation partners, language institutes, or subcontractors to fulfill contractual obligations.
CuraPersonal independently determines operational methods necessary for proper service execution.
Unless explicitly agreed otherwise, CuraPersonal does not provide legal advice regarding immigration, tax, labor law, or residence law matters.
13. Remuneration and Payment Terms
Placement commissions and agreed service fees become payable according to the respective contractual agreement.
Invoices are payable within 30 days from the invoice date without deductions unless otherwise agreed in writing.
Late payments may be subject to statutory default interest in accordance with German law.
Placement fees remain payable if an employment contract is concluded due to recruitment activities initiated by CuraPersonal, even after termination of the cooperation agreement within the agreed protection period.
14. Reimbursement of Expenses
Agreed external expenses, including:
- advertising costs
- translation costs
- certification fees
- travel expenses
- visa-related administrative fees
- and database fees
may be reimbursed by the client if contractually agreed.
Additional expenses require prior written approval.
15. Confidentiality and Data Protection
CuraPersonal undertakes to treat all client and candidate information confidentially and in accordance with applicable data protection laws, including the GDPR.
Candidate documents and personal data shall only be processed for recruitment-related purposes.
Confidential information may not be disclosed to unauthorized third parties.
16. Liability
CuraPersonal shall be liable only in cases of intent or gross negligence, except where mandatory statutory provisions apply.
Liability for slight negligence shall be limited to foreseeable and contract-typical damages.
CuraPersonal shall not be liable for:
- indirect damages
- loss of profit
- business interruption
- or decisions made independently by employers or candidates.
Liability limitations do not apply in cases involving injury to life, body, or health.
17. Storage and Return of Documents
Documents provided by clients shall be securely stored for the legally required retention period.
Upon request and where legally permissible, documents may be returned or deleted after termination of the contractual relationship.
18. Non-Solicitation / Loyalty Clause
During the contractual relationship and for a period of 12 months thereafter, neither party shall actively solicit or hire employees of the other party without prior written consent.
19. Transfer of Contract
CuraPersonal may transfer contractual rights and obligations to affiliated companies or legal successors where this does not materially affect the client’s legitimate interests.
20. Final Provisions
German law shall apply exclusively.
Should individual provisions of these Terms & Conditions become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
The place of jurisdiction, where legally permissible, shall be Eschborn Main-Taunus-Kreis , Germany.
