Terms & Conditions

For the recruitment and personnel search of CuraPersonal, department of CuraPersonal GmbH & Co. KG, Mammolshainer Weg 14, D-61462 Königstein im Taunus.

1. Scope

These general terms and conditions apply exclusively to the personnel search services and recruitment brokerage activity of CuraPersonal.

These conditions apply in addition to all recruitment contracts and personnel training agreements concluded between CuraPersonal and the customer.

2. Personnel Search

CuraPersonal undertakes the pre-selection of suitable candidates through application reviews, interviews, and reference checks where possible.

Interview coordination and communication with candidates are managed by CuraPersonal.

CuraPersonal does not guarantee the authenticity or accuracy of candidate-provided documents such as certificates or diplomas.

Recruitment services are provided according to German employment laws and regulations.

3. Recruitment

CuraPersonal provides recruitment services by introducing suitable candidates to customers.

Customers must immediately inform CuraPersonal if they already know a proposed candidate.

Recruitment services are carried out in compliance with applicable German laws and regulations.

4. Client’s Duty to Cooperate

Customers must appoint a contact person for communication regarding recruitment and personnel search.

After successful interviews, the customer is responsible for completing all hiring procedures.

5. Changes to Requirements

Customers may request written changes to recruitment requirements.

CuraPersonal may object to or renegotiate timelines and fees if additional work is required.

If personnel search becomes unnecessary, the customer must notify CuraPersonal immediately.

6. Service Provision

CuraPersonal may use employees, freelancers, or subcontractors to fulfill recruitment services.

CuraPersonal independently determines working methods necessary for proper task execution.

The company does not provide legal advice regarding visas, residence permits, or work permits.

7. Remuneration

Placement commissions are payable even if employment contracts are concluded after contract termination due to recruitment activities initiated by CuraPersonal.

Invoices are payable within 30 days without deductions.

Late payments are subject to statutory default interest.

8. Reimbursement of Expenses

Customers reimburse agreed expenses such as advertising fees, database fees, and candidate travel expenses.

Other expenses require prior written approval.

9. Confidentiality

CuraPersonal and its employees are obligated to maintain confidentiality regarding all customer and candidate information.

Candidate documents remain the property of CuraPersonal and must not be shared with third parties.

Customer information will only be used for recruitment and personnel search purposes.

10. Liability

Liability for slight negligence is limited to EUR 2.5 million.

Liability does not apply to intentional misconduct, gross negligence, or injury to life and health.

CuraPersonal is not liable for lost profits or indirect damages.

11. Storage & Return of Documents

CuraPersonal securely stores business and operational documents provided by the customer.

Upon request or contract termination, documents will be returned to the customer.

12. Transfer of Contract

CuraPersonal may transfer contractual rights and obligations to affiliated companies without further approval.

Such transfers do not constitute grounds for termination of the contractual relationship.

13. Loyalty Clause

During the contract period and for 12 months afterward, neither party may hire employees of the other party without prior written consent.

14. Final Provisions

German law applies to these Terms & Conditions.

Invalid provisions do not affect the validity of the remaining provisions.

The place of jurisdiction for disputes is Königstein im Taunus.
